Terms of Use

These terms set the conditions for using Pairfit (the "App"). The App is operated by Process Craft AI (Sakino) ("we"). By using the App, you agree to these terms and to our Privacy Policy.

1. License agreement

In addition to these terms, Apple's standard Licensed Application End User License Agreement applies. If these terms and that agreement conflict, that agreement prevails.

2. Who can use the App

The App is for people aged 13 and over. People under 13 may not use it. If you are under 18, get permission from a parent or guardian before using it.

3. Free features and Pairfit Pro

4. Subscriptions

Pairfit Pro is an auto-renewable subscription, with a yearly plan (7-day free trial for new subscribers) and a monthly plan. Prices are shown in your local currency in the App Store before you subscribe. In Japan, the yearly plan is ¥4,800 and the monthly plan is ¥800, tax included.

• Payment: Payment is charged to your Apple Account when you confirm the purchase. With a free trial, you are charged when the trial ends.
• Auto-renewal: The subscription renews for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged within 24 hours before the end of the period.
• Free trial: The 7-day free trial is only for people new to Pairfit subscriptions. Cancel at least 24 hours before it ends and you will not be charged.
• Cancelling: Go to iPhone Settings > your name at the top > Subscriptions > Pairfit and tap Cancel Subscription. If you cancel mid-period, you keep Pairfit Pro until the period ends. Deleting the App does not cancel your subscription.
• Refunds: Refunds follow Apple's rules. We cannot issue refunds ourselves. See Apple's refund page.
• Family Sharing: Not supported (see 5 for how a pair shares one subscription).

5. One purchase covers both partners

• When either member of a pair buys Pairfit Pro, both members can use Pairfit Pro.
• If the purchaser ends the pair or deletes their data, the other member can no longer use Pairfit Pro. The purchaser can use it with a new pair after pairing up again and tapping "Restore Purchases" in Settings.
• If the purchaser's subscription is cancelled, expires or is refunded, neither member can use Pairfit Pro.
• If both members subscribe, each is charged separately. To cancel one of them, follow "Cancelling" in 4.

6. Favors and fallbacks

• Favor cards and fallbacks are promises between the two members of a pair. The App only records and shows the cards, the card drawn in a missed week, and whether it is done. Our server decides the card for each week, and it cannot be redrawn.
• The App does not handle money between users and offers no way to pay. The two of you decide whether and when to carry out a favor or fallback.
• Write cards your partner can easily agree to. Do not use the App to bet money, to pressure your partner into something they do not want, or to involve other people.
• We are not responsible for anything that happens between the two of you over a favor or fallback.

7. Photo rules

• Take photos as a record of your own workouts.
• At the gym or outdoors, keep other people out of the frame. Do not post photos that show other people. The second back-camera photo is off unless you turn it on.
• Do not post nude or sexual photos, violent photos, or photos that infringe other people's rights.
• Do not save or publish your partner's photos without their consent.

8. Exercise and your health

• If you feel chest pain, shortness of breath or dizziness while exercising, stop right away and see a doctor if needed.
• Do not push yourself to exercise when you feel unwell just to meet a goal, a step target or a favor.
• The App is for keeping a record of workouts. It does not give medical or health advice.

9. Prohibited conduct

When using the App, you must not:

• Break the law or act against public order
• Break the photo rules in 7
• Modify, decompile or disassemble the App
• Get around payment, or log workouts in bulk with programs
• Hurt, threaten or harass your partner or anyone else
• Harm our servers, us or anyone else

If we find such conduct, we may delete the photos or workouts involved and stop your use of the App without notice. If you have a problem with your partner, end the pair and write to us at the address in 15.

10. Ending a pair and your data

You can end your pair any time in Settings > End pair. Your partner can then no longer see your workouts or photos. Settings > Delete all data deletes your photos, workouts and account. See the Privacy Policy for details.

11. Changes to the App and ending service

We may change the App or stop providing it. If we remove paid features or stop the service, we will tell you in advance.

12. Disclaimer

• We do not guarantee that the App is free of bugs, works on every device, fits your purpose or always delivers notifications.
• If we are liable for damage caused by using the App, our liability is limited to the greater of the amount you paid for the App in the 12 months before the damage and 10,000 yen. This limit does not apply to damage caused by our intent or gross negligence.
• These terms do not limit any rights you have under laws that cannot be excluded, such as Japan's Consumer Contract Act.

13. Changes to these terms

We may change these terms in line with Japan's Civil Code. We will post the new terms and their effective date on this page before they take effect.

14. Governing law and jurisdiction

These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute about the App.
